Gilbert's rules for where a pool can go and how it's fenced come from section 5.2.7 of its Land Development Code and a town policy statement on pool barriers. They matter for the excavation because the dig has to land where the pool is allowed to be.

The barrier

  • Height: the enclosure must be at least 5 feet and no more than 6 feet high, measured on the side away from the pool.
  • What counts: a house wall, a solid wall, or chain link or wrought iron fencing.
  • Gaps: openings small enough that a 4-inch sphere can't pass through or under.
  • Gates: about the same height as the fence, self-closing and self-latching. A double-width gate that isn't the only way in or out stays padlocked when not in use.
  • Climbable things: raised planters, decks and water features stay at least 3 feet from a pool fence.
  • Neighbors: if a new pool would put a neighbor's pool out of compliance, the new one shouldn't pass inspection until both comply.

Inside fences over 3 feet need their own building permit and inspection, but don't have to meet pool fencing rules if the property's outer fence does.

Exceptions

Temporary rubber or plastic wading pools holding 18 inches of water or less are exempt. Where a pool backs onto a body of water in an approved Planned Area Development, the fence along the water isn't required if the enclosure extends 18 inches past the lake bank.

The policy statement is dated April 22, 2003. Confirm the current rules with Gilbert's Development Services before you build.
